Mr Steven Chu (Developer's representative) telephoned Mr Tan Kim Hai (residents' representative) and called off the meeting on 28.5.05 because the Developer didn't agree to the discussions of  the meeting on 21.5.05 to be put  up on the botanicowner.com website.

The Developer met with YB Teng Chang Kim and residents' representatives to discuss about defects in the houses and ways to make good the defects. The          Developer arranged for the   residents' representatives to meet the Developer's consultants on 28.5.05.

Majlis Perbandaran Klang (MPK) sent officers to visit Phase 5 to investigate the defects in the houses. Residents await for MPK's report on the investigation.

Summary Of Meeting On 21/5/2005

SUMMARY OF MEETING BETWEEN HARUM INTISARI SDN BHD (HISB) AND THE RESIDENTS’ REPRESENTATIVES FOR HOUSE BUYERS OF PHASE 5A ON SATURDAY 21.5.05 AT 2.30PM AT THE SALES OFFICE OF HISB, AMBANG BOTANIC, KLANG

2.   MATTERS ARISING

 

2.1. CONSTRUCTION TO BE ACCORDING TO SALES BROCHURE AND SALES AGREEMENT

 

2.1.1  Brick Wall complete with mild steel grille fencing to be 5’ high as promised in sales agreement and sales brochure.

2.1.2 All side fencing to be 5’ brick wall complete with mild steel grille as promised in sales brochure.

2.1.3  Timber strip to be as promised in sales brochure and what was shown by HISB sales representative

 

 

2.2  CONSTRUCTION TO BE ACCORDING TO APPROVED PLANS

 

2.2.1    Letter box, refuse chamber, water meter and electrical meter compartment to be constructed according to the approved plans.

2.2.2    Size of refuse chamber pipe to follow the approved plans.

2.2.3    Size of electrical inlet wire to the main board should be 25mm square.

2.2.4    Driveway shall have cement render.

2.2.5    Short of one backyard drainage outlet and the design is different from approved plan. The pipe lay to be 6” diametre class D PVC pipe.

2.2.6    CT point location is wrong.

2.2.7    Manhole is undersize. Manhole to be empty (without stagnant water) at all times.

2.3.8    Every 4 course bricks to be laid with “EXMET”.

2.3.9    Roofing rafter to follow specifications, ceiling support (use 2” x 2” wood only), ceiling manhole is undersize.

2.2.10   To make good water pipes running above electrical lines.

2.2.11   Party wall to be built according to by-laws.

2.2.12   Rain gutters to be installed according to approved plans and by-laws.

2.2.13   Air well to be built according to by-laws.

2.2.14   To lay electrical wire in conduit properly.

2.2.15   To change the fan hook because of improper installation and design.

 

 

2.3  Environmental matters

 

2.3.1  Flooding and ponding of rain water along roads in some phases of Bandar Botanic.

2.3.2 Drainage system to use concrete drains and not plastic pipes to avoid maintenance problems.

2.3.3  HISB to provide schedule for and method of maintenance of the lake.

2.3.4  HISB to ensure the cleanliness of the lake to reach the standard of the present lake in Ambang Botanic.

 

 

3.   DISCUSSIONS

 

3.1      Residents' representatives

3.1.1    To rectify the matters according to the representations made in the sales brochure, the sales agreement, the approved plans and by-laws.

3.1.2    To consider compensation as an alternative solution to settling the matters.

3.1.3    To consider buying back the houses from purchasers at the sale agreement price.

 

3.2      HISB

3.2.1    Agreed to look into the matters arising from sales agreement and approved plans.

3.2.2    Agreed to give a list of items which HISB is willing to rectify immediately and to ask for purchasers’ consent to make good the defects.

3.2.3    Agreed to arrange for meeting between consultants and committee members to discuss matters pertaining to by-laws.

3.2.4    Not agreeable to compensation as an alternative solution to the matters.

3.2.5    Not HISB’s practice to buy back houses from purchasers.

 

 

4.   CONCLUSION

 

4.1  The meeting ended at 5.00pm.

 

4.2  The next meeting between HISB’s consultants and the committee members will be held at HISB sales office at 2.30pm on Saturday, 28.5.05.
